1 License to Access and Use the Service

Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Service for lawful purposes. We may terminate or revoke this license at any time, including for violations of these Terms or law. Compatibility with your devices and operating systems is your responsibility. We may deploy updates, patches, or changes from time to time.

We reserve the right to change these Terms and associated policies or procedures from time to time with or without prior notification.

1.1 No Resale or Sublicense

You may not resell, rent, lease, lend, sublicense, time-share, provide as a service, or otherwise make the Service or any access credentials available to third parties without our prior written consent.

1.2 Storage & Data Retention

We may impose storage limits per user and may delete or archive stored content after extended inactivity, consistent with the Privacy Policy and law.

2 Rights Reserved by the Company

We may, at any time and without prior notice, do any of the following: 

(a) modify, suspend, or end all or part of the Service; 

(b) restrict or revoke your access; 

(c) verify information you provide; 

(d) assess compliance with these Terms and applicable law; 

(e) suspend or terminate accounts for violations; 

(f) remove or refuse content in our reasonable judgment; 

(g) monitor usage, including messages, where permitted by law and these Terms; 

(h) investigate suspected misuse and cooperate with authorities; 

(i) disclose information in response to lawful requests (e.g., subpoenas, court orders) or to protect users, the public, or our rights; and 

(j) change payment or payout processors.

2.1 Law Enforcement

We respond to valid legal process and emergency disclosure requests according to law. We may seek reimbursement for reasonable costs of compliance to the extent permitted. Requests must be narrowly tailored, identify the account or content at issue, and specify the legal basis. Non‑U.S. authorities should use appropriate international channels unless an emergency exception applies.

3 User Content

We do not claim ownership over user-submitted media ("User Content"). The views and opinions expressed in User Content are those of the users and do not reflect the views of QuinkyPeople.com or the Company. Transactions and interactions involving User Content occur between users, and QuinkyPeople.com is not a party to those dealings. Subject to these Terms, users may access content for personal use through platform features. Except where the platform explicitly enables downloading (e.g., a visible "Download" button), you may not copy, record, screenshot, redistribute, broadcast, sell, license, or otherwise exploit User Content without the prior written consent of the Company or the respective rights holder. No license is granted by implication, estoppel, or otherwise. We make no promises regarding the accuracy, quality, legality, or availability of User Content and disclaim responsibility for user disputes.

3.1 Prescreening and Moderation

User Content may be pre-screened or moderated. Your User Content must comply with these Terms and all applicable payment processor rules. We may, at any time and for any reason, demote or terminate your account, and demote, remove, or refuse to publish any User Content, with or without prior notice.

3.2 Links to  QuinkyPeople.com

You may link to public pages in a fair and lawful manner without implying sponsorship or endorsement so long as it does not damage our reputation. Do not frame the Service or misrepresent your relationship with us.

3.3 Links to Third‑Party Sites

Outbound links are provided for convenience. We do not control or endorse third‑party sites and are not responsible for their content, policies, or practices. Access is at your own risk.

3. Intellectual Property Rights

3.1 Copyrights

Except for User Content, all aspects of the Platform—including without limitation all software, source code, text, graphics, images, audio, video, interfaces, design elements, layouts, compilations, databases, and the selection and arrangement thereof—are owned by the Company or its licensors and are protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property and proprietary rights laws.

3.2 Reservation of Rights

Except for the limited rights granted to you with respect to your own User Content, no right, title, or interest in or to the Platform or any materials on it is transferred to you. All rights not expressly granted in these Terms are fully reserved by the Company and its licensors.

3.3 Restrictions on Use.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any material on the Platform unless expressly permitted in these Terms. The only exceptions are:

  1. Temporary technical copies: Your device may store transient copies of Platform materials solely as necessary for you to access and view them.

  2. Browser caching: You may retain files automatically cached by your browser for ordinary display optimization.

Except for the limited rights expressly granted above, no rights or licenses are provided, whether by implication, estoppel, or otherwise. Any unauthorized use of the Platform’s materials may violate intellectual property laws and these Terms.

3.4 Trademarks

QuinkyPeople.com, and associated logos are trademarks or trade dress of the Company. Do not use our marks without written permission, including in keywords, domains, or usernames likely to confuse. No license is granted by implication, estoppel, or otherwise.

3.5 Copyright Violation

Any access or use of the Platform that is not expressly permitted under these Terms constitutes a breach and may violate copyright, trademark, and other applicable laws. If you print, copy, modify, download, or otherwise use, share, or provide access to any portion of the Platform in violation of these Terms, your authorization to use the Platform terminates automatically. At our direction, you must immediately delete or return all copies of the affected materials.

3.6 DMCA Agent and Takedown Procedure. 

We comply with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). Upon receiving a valid notice of alleged copyright infringement, we will take appropriate action, which may include removing or disabling access to the disputed User Content and, where warranted, terminating the account of the User responsible for the infringement. 

Our designated agent information is posted in our DMCA Policy; if unavailable, email support@quinkypeople.com with the subject “DMCA Notice.” You must include: 

(a) a signature of the rights owner or agent; 

(b) identification of the infringed work; 

(c) identification of the material claimed to be infringing with URLs; 

(d) your contact information; 

(e) a statement of good‑faith belief; and 

(f) a statement under penalty of perjury regarding accuracy and authority. 

Counter‑notifications must meet §512 requirements. Misrepresentations may expose you to liability.

4. Accessibility Statement

4.1 Commitment

The Quinky Company is committed to making its digital properties accessible to all people, including those with disabilities. We are continuously working to improve the user experience for everyone and strive to apply the necessary accessibility standards.

4.2 Standards

4.3 User Content

We are not responsible for ensuring that user-generated content meets accessibility standards. We aim to provide tools and features to allow users to ensure that their content is accessible to all, and we recommend that they make use of them, but we cannot guarantee that users will comply.
