1. Overview of prohibited items
The following types of items are prohibited or restricted on the Service:
Alcohol, Tobacco, Drugs, Drug Paraphernalia, Medical Drugs and Devices, and Items making Medical Claims
Animal Products and Human Body Parts and Fluids
Dangerous Items: Hazardous Materials and Devices, Recalled Items, and Weapons
Hate Items: Items that Promote, Support, or Glorify Hatred
Violent Items: Items that Promote, Support, or Glorify Violence
Illegal Items, Items Promoting Illegal Activity, and Highly Regulated Items
Internationally Regulated Items
We reserve the right to remove any item from sale that in our sole discretion is not appropriate for the Service, even if it is not specifically listed as prohibited.
1.1 Seller Responsibility
It is the responsibility of the Seller to ensure that all items offered for sale on the Service comply with this Policy. If in doubt, contact support@quinkypeople.com and ask for clarification before listing an item for sale.
1.2 Vetting and Curation
We reserve the right to determine whether an item is appropriate for sale on the Service.
We may use automated and tools and human moderators to evaluate items for compliance with this Policy.
We may require Sellers to provide full details of an item before permitting in to be listed.
1.3 Violations
If you encounter a prohibited item, you must report it to support@quinkypeople.com. We will normally respond to a report within 3 business days.
2. Drugs
Alcohol, tobacco, drugs, medical drugs, medical devices, and items making medical claims are prohibited on The Service because they may be subject to legal requirements, are sometimes considered controlled substances, or are inconsistent with the spirit of The Service.
Prohibited Items:
Alcohol.
Tobacco products, smokeable products, e-cigarettes, and e-liquid.
Drugs and certain herbal substances, including substances used for recreational and medicinal purposes, regardless of their legality; this prohibition also extends to depictions of these substances in listing photos, as well as listings for instructions or materials intended to create such items.
Drug paraphernalia, including, for example: items with a carburetor; slides and/or items with a slide; bongs and bubblers; and vaporizers and their components.
Medical drugs and regulated medical devices.
Items making medical claims.
3. Human and Animal Products
Certain human and animal products are highly regulated and prohibited on The Service due to the risk of harm to live, companion, or at-risk animals.
Prohibited Items:
Live animals.
Items created using any endangered or threatened animal species or certain at-risk animals; this includes animal species designated as threatened or endangered by the US Endangered Species Act or listed in Appendix I of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), as well as certain additional at-risk animals.
Items made from cat and dog parts or pelts as defined by US Federal Law.
Ivory or bones from ivory-producing animals, including tusks, elk ivory, fossilized ivory, and wooly mammoth ivory.
Human remains, products, or parts from the human body (except for teeth, nails, and hair).
Bodily fluids, including dried fluids (blood, semen, urine, etc).
Used clothing.

If you are shipping items across international borders you should also consult CITES for specific information about importing and exporting species that may be threatened. If you sell products containing feathers, you should also consult the Migratory Bird Treaty Act.
4. Dangerous Items
For safety and legal reasons, The Service prohibits certain dangerous items from the marketplace, including hazardous materials, recalled products, and items intended to inflict harm.
Prohibited Items:
Hazardous materials and devices, including kits, instructions, patterns, and designs enabling their creation, such as: explosives (fireworks or sparklers), explosive precursors, flammable items, gases, radioactive material, and toxic substances,.
Individual or loose lithium-ion batteries.
Electric mobility devices (like bikes, scooters, and mopeds) and their functional accessories.
Items that have been recalled by governments or manufacturers.
Items that may pose a health or safety hazard (e.g., items presenting a choking, electrocution, or strangulation hazard).
Certain loose or separable high-powered magnets that exceed specific size and flux limits.
Any item intended to be used as a weapon to inflict harm.
Guns, knives, or other blatant weapons, even if vintage.
Imitation firearms and weapons that look real or are prohibited by US law.
Patterns, designs, plans, or instructions for the creation of prohibited weapons.
Examples of What is Acceptable:
Culinary knives or other knives used as tools.
Letter openers.
5. Hate Items
Items that promote, support, or glorify hatred are prohibited because The Service has a zero tolerance policy for such items and seeks to be a community where people of all backgrounds feel welcome,.
Prohibited Items:
Items or listings with violent or degrading language toward people based upon protected classes, which include race, ethnicity, national origin, religion, gender, gender identity, disability, sexual orientation, immigration status, or caste.
Content that directly or indirectly contains violent or degrading commentary against protected classes.
Items that support or commemorate current or historical hate groups or their leaders, including propaganda or collectibles; examples include Nazi or Neo-Nazi groups, Ku Klux Klan (KKK) groups, white supremacist groups, or groups that advocate anti-gay, anti-immigrant, or Holocaust denial agendas.
Items that contain slurs or derogatory terms in reference to protected classes.
Examples of What is Acceptable:
Some items may contain symbols or terms associated with hateful rhetoric if they are in a context unrelated to hateful intent. This will be evaluated on an individual, case-by-case basis.
Swastikas are allowed only when part of a clear religious or cultural context (Example: Vintage Buddhist Swastika Pendant, Hindu Brass Sculpture).
6. Violent Items
The Service prohibits items that promote, support, or glorify acts of violence or harm toward self, others, or animals to ensure the marketplace remains a safe place for everyone,.
Prohibited Items:
Items or listings that promote, support or glorify acts of violence or harm towards self, others, or animals, including credible threats of harm.
Items that glorify human suffering or tragedies, including items that praise or honor perpetrators of violence.
Items that glorify or celebrate real-world incidents of violence or natural disasters.
Items that threaten or encourage credible acts of violence against individuals or groups.
Items that promote or support terrorism or terrorist organizations.
Items that encourage self-mutilation, starvation, or other self-harm.
Items that promote or endorse harmful misinformation.
Examples of What is Acceptable:
Commemoration of violent events, provided there is no glorification (Example: A World War I Relic).
Items with violent rhetoric that use vague or nonspecific statements that do not indicate a credible threat of real-world harm.
7. Illegal Items
The Service respects the law and prohibits illegal items, stolen goods, items promoting illegal activity, and certain highly regulated items, strictly forbidding any depictions of sexual activity that violate the law.
Prohibited Items:
Illegal items, stolen items, and items that promote illegal activity,.
Unauthorized or counterfeit goods, including items that imitate an authentic good by using a brand’s name, logo, or protected design without consent,.
Unauthorized replicas or copies of items, and patterns or designs enabling their creation.
The sale of personal information, personal or government documents (such as credit cards, identification cards, and licenses),.
Highly regulated items, such as current, exchangeable currency and postage, real estate, motor vehicles, lottery tickets, cryptocurrency mining rigs, and financial instruments like stocks, bonds, and other securities,.
Listings that facilitate or promote illegal activity, including aiding in impersonation (such as realistic items that identify the wearer as active law enforcement or government official), evasion of detection of illegal activity (such as radar detectors or license plate covers), or falsified qualifications (such as fraudulent diplomas or service animal designations).
Depictions of the sexualization of minors.
Depictions of illegal sexual activity, including but not limited to, child sexual abuse material (CSAM) or incest.
Examples of What is Acceptable:
Depictions of adult nudity and sexual content (such as illustrative artwork depicting female nipples or buttocks, or illustrative depictions of genitalia without sexual context), provided they do not show or endorse illegal sexual activity, and if photographic, they follow proper content listing requirements.
Collectible postage or currency priced at less than 1,000 USD, unless subject to legal or other restrictions.
Items made by a seller containing current or exchangeable currency, provided the currency is in an unusable condition.
8. Internationally Regulated Items

Due to the complexities of global commerce, The Service requires compliance with all international, national, and local laws and regulations concerning the import and export of goods.
Prohibited Items/Compliance Requirements:
Users are responsible for complying with the laws and regulations of both the country of destination and their local laws when buying or selling items across international borders.
Users must comply with economic sanctions and trade restrictions, including those implemented by the Office of Foreign Assets Control ("OFAC") of the US Department of the Treasury.
Members must comply with the sanctions policy of The Service, regardless of their location.
Users should be aware that third-party payment processors, such as PayPal, may independently monitor transactions for sanctions compliance and may block some transactions.
The Service reserves the right to request sellers provide additional information, disclose an item's country of origin in a listing, or take other steps to meet compliance obligations.
Certain items might be prohibited from exporting or importing under international laws and regulations.
Some transactions may require licenses, permits, or other documentation.
Examples of What is Acceptable:
Informational materials such as publications, films, posters, phonograph records, photographs, tapes, compact disks, and certain artworks, as sanctions programs may have exceptions for these items.
Items that do not originate from a sanctioned area but merely reference it.
Items described as being in the style of a sanctioned area (Example: "Cuban Style Fedora Hats").
Informational materials such as art, books, film, photos, or music (Example: Vintage Biography of Fidel Castro).
9. Changes to this Policy
We reserve the right to change these Terms and associated policies or procedures from time to time with or without prior notification.
